RULE 26

 ELIGIBILITY CRITERIA

IN GENERAL

Sec. 1  In making a determination of eligibility for special education under this rule, a student shall not be determined to be a student with a disability if the key factor for such a determination is lack of instruction in reading or math or limited English proficiency, and the student does not otherwise meet the eligibility requirements of this rule.

Autism spectrum disorder

Sec.2  (a) Autism spectrum disorder is a lifelong developmental disability that includes autism, Asperger's Syndrome, and other pervasive developmental disorders.  This disability is generally evident before three (3) years of age and significantly affects verbal and nonverbal communication and social interaction and results in an adverse affect on the student's educational performance.  Other characteristics often associated include the following: 

(1)  Engagement in repetitive activities and stereotyped movements

(2)  Resistance to environmental change or change in daily routines

(3)  Unusual responses to sensory experiences.
