RULE 26

 ELIGIBILITY CRITERIA

511 IAC 7-26-1

In general

Sec. 1  In making a determination of eligibility for special education under this rule, a student shall not be determined to be a student with a disability if the key factor for such a determination is lack of instruction in reading or math or limited English proficiency, and the student does not otherwise meet the eligibility requirements of this rule.

Mental disability

Sec. 9  (a)  A mental disability;

(1)  is demonstrated by significantly below average general intellectual functioning existing concurrently with deficits in adaptive behavior; and

(2)  adversely affects educational performance.
