RULE 26

 ELIGIBILITY CRITERIA

In general

Sec. 1  In making a determination of eligibility for special education under this rule, a student shall not be determined to be a student with a disability if the key factor for such a determination is lack of instruction in reading or math or limited English proficiency, and the student does not otherwise meet the eligibility requirements of this rule.

Hearing impairment

Sec. 7 (a) A hearing impairment is hearing loss that:

(1)  with or without amplification adversely affects educational performance and developmental progress;

(2)  may be permanent or fluctuating;

(3)  may be mild to profound in nature;

(4)  may be unilateral or bilateral; and

(5)  may also be referred to as hard of hearing or deaf.
